The Supreme Court has confirmed 10,000 Euros for damages in favor of a Florentine family who lived above a bar frequented by many people smoking cigarettes outside the room, thus preventing the family to open the windows of the house and live freely in their apartment. In essence, the Supreme Court - rejecting the use of 'Il Piccolo Caffe''- has validated the right of the family in question consists da padre, madre e una figlia, ad ottenere il risarcimento per "danni esistenziali determinati da immissioni moleste di fumo di sigarette". In particolare i giudici della Cassazione (con la sentenza 7875) hanno reso definitiva la decisione emessa il 10 luglio 2007 dalla Corte d'Appello di Firenze con la quale il risarcimento era stato decretato a causa delle "conseguenze delle immissioni del fumo delle sigarette sul modo di vivere la casa della famiglia danneggiata".
